Family Law has developed over time and encompasses a wide range of legal issues that often require a trial or court ordered settlement. Family law over time has become an ever increasing and useful resource for individuals and families with legal questions, concerns and complaints. The battle of divorce, or child custody disagreement or even a prenuptial agreement can be settle utilizing the principles surrounding family law. Here are some of the ways in which family law can be used in and outside of a court room.
1.) Divorce- Family law can be used to determine the outcome of a divorce. During and after a divorce there are many legal issues to resolve and Family law provides the means by which these issues are resolved in a court. The court will determine the outcome depending on the situation and the individual’s case, however Family law principles will govern throughout.
2.) Child Custody- After a divorce the court will need to determine who who gain custody of a child or children with a divorced couple and Family Law also encompasses this topic. A court will come to a resolution if no agreement can be made and agreed upon by both parents outside of court. Once Family law is put into action and a court has predetermined the child custody agreement it must be adhered to.
3.) In combination to child custody, child support is also determined by Family law. If one parent is given custody of the child the other parent will still be liable under Family law to provide for that child and the specifics of that requirement will be determined by the court as well.
4.)Living Arrangements- Under family law, a court can also determine the domestic relationship situation of a given individual or set of individuals. This can encompass any of the family law principles surrounding common law marriages, legal money and property issues of those who live together but are not married and so on.
5.) Adoption- This law will also be utilized when couples or individuals are looking to adopt a child or multiple children. A court will request legal documentation of this event and law principles can be applied in this instance as well.
6.) Domestic Abuse- However unfortunate, domestic abuse still exists and Family law principles govern this topic as well. A court will determine the outcome of a domestic abuse case if it is brought to trial. Those who are convicted of domestic abuse are liable to serve jail time depending on the severity of the offense and the charges filed by the injured party.
